Section 2(b) of the Irish Data Protection Act

The following are valid Lawful processing conditions for processing sensitive personal data.

  • Explicit consent of the data subject
  • Obligations in connection with employment
  • Vital interests of the data subject or another person
  • Legitimate activities of a not for profit organisation
  • Information deliberately made public by the data subject
  • Administration of Justice/Lawful purpose/Government function
  • Processing necessary in relation to legal rights
  • Medical purposes
  • Statistical purposes
  • Processing by political parties
  • Substantial public interest
  • Assessment or collection of tax
  • Administration of Social Welfare
